Padma Ati Software User Registration Agreement

Dear User,

Welcome to the applications and services of Padma Ati. This agreement establishes the rights and obligations between Padma Ati and users regarding software services (hereinafter referred to as "Services"). A "user" refers to any individual or related party who registers, logs in, or uses these software services. This agreement may be updated at any time by Padma Ati and Jeta's Grove Charitable Trust, and the updated terms will immediately replace the previous terms without further notice. Users can review the latest version of the terms within the software. If users do not accept the modified terms after any changes, please cease using the services immediately. Continued use of the services will be deemed as acceptance of the modified agreement.

1. Agreement Content

This agreement is a legal document between users and Padma Ati (Jeta's Grove Charitable Trust) regarding user registration and service usage. It establishes the rights and obligations between Padma Ati and users concerning the services. This agreement may be updated at any time by Padma Ati and Jeta's Grove Charitable Trust, with updated terms immediately replacing previous ones. Users can review the latest version of the terms on the software platform.

2. Acceptance of Service Terms

By completing the software registration process, users indicate their acceptance of these service terms and agree to be bound by them. Users warrant that the information they submit is true, accurate, current, and complete. Users referred to in this service agreement are those who fully agree to all terms and complete the registration process.

Changes and Modifications to Service Terms

Padma Ati and Jeta's Grove Charitable Trust reserve the right to change, modify, add, or remove portions of these terms at any time. All modifications form part of this service agreement. Users will be notified of any changes within the software. If users disagree with the modifications, they may voluntarily cancel their services; continued use of the services indicates acceptance of the modified terms.

3. Service Description

Padma Ati provides Buddhist educational resources to users via the internet, including online courses, scripture studies, practice guidance, educational videos, and other content (hereinafter referred to as "the Services"). Unless explicitly stated otherwise, any new features that enhance or augment the current services, including new products, are unconditionally subject to these service terms.

Padma Ati assumes no responsibility for network services; users assume all risks associated with using the services. Padma Ati does not guarantee that services will meet user requirements, nor does it guarantee uninterrupted service or warrant the timeliness, security, or accuracy of the services.

A. To use these services, users must:

  1. Provide their own equipment necessary for internet access, including computers, mobile devices, etc.
  2. Pay any associated service fees (if applicable).

B. Users accepting these services must agree to:

  1. Provide complete, truthful, accurate, and current personal information
  2. Update registration information promptly

4. Legal Compliance

Users must understand the borderless nature of the internet and particularly observe all relevant local laws and regulations. If Padma Ati has reasonable grounds to believe that a user's behaviour may violate local laws or regulations, it may terminate services to that user at any time without prior notice.

5. Information Collection

Users must provide personal information when registering for Padma Ati services. Padma Ati collects personal information to provide users with a better learning experience and services.

Personal information includes:

  • Basic information: name, contact details, email address
  • Learning records: course progress, study duration, examination results
  • Device information: device type, operating system version, network status

Information Usage Principles:

  1. Padma Ati commits to strict confidentiality of user personal information
  2. User personal information will not be provided to third parties without user consent
  3. User information will only be used as necessary to provide services

6. User Conduct Standards

When using the services, users shall:

  1. Comply with relevant laws and regulations
  2. Respect Buddhist teachings
  3. Maintain a positive learning attitude
  4. Not disseminate illegal or inappropriate information
  5. Not infringe upon others' legitimate rights

7. Intellectual Property Rights

All content within the software and services (including but not limited to text, images, audio, and video) is the intellectual property of Padma Ati and Jeta's Grove Charitable Trust or their partners. Without written permission from Padma Ati, no organisation or individual may copy, modify, distribute, or use the content in any way. Please note: Any unauthorised use, copying, or tampering with content, including but not limited to creating misleading, harmful, or defamatory materials, distorting original content, or causing reputational damage, is strictly prohibited. Website and APP content must not be redistributed, uploaded to third-party platforms, or incorrectly marked as "original". Padma Ati and Jeta's Grove Charitable Trust reserve the right to take legal action against any individual or entity engaging in such behaviour, including seeking compensation for reputational damage, economic loss, or other negative consequences resulting from unauthorised or malicious use of content.

8. Service Suspension and Termination

Padma Ati reserves the right to suspend or terminate services at any time, including but not limited to:

  1. User violation of this agreement
  2. Requests from relevant authorities
  3. System maintenance or upgrades
  4. Force majeure circumstances

9. Disclaimer

  1. Padma Ati is not liable for losses caused by network service interruption or other force majeure factors
  2. Users bear any direct or indirect losses arising from service use
  3. Users assume all risks associated with using third-party links or services

10. Dispute Resolution

These service terms shall be governed by, performed, and interpreted under New Zealand law. If any provision of this agreement conflicts with local law and becomes invalid, it shall not affect the validity of other provisions.

11. Other Terms

  1. Section headings are for reading convenience only and do not affect agreement interpretation
  2. If any provision is deemed invalid, other provisions remain in effect
  3. Failure to exercise or enforce any right or provision does not constitute waiver of such right or provision

14. Notifications

Padma Ati may notify users via email, page announcements, regular mail, or other suitable forms. When service terms are modified or other matters change, Padma Ati will provide notification through these methods.

15. Applicable Law and Jurisdiction

These service terms shall be governed by, performed, and interpreted under New Zealand law, with disputes submitted to the Auckland Arbitration Commission, whose arbitration decisions shall be final. If any provision conflicts with local law and becomes invalid, it shall not affect the validity of other provisions.

16. Complaints

If you believe we have violated your privacy rights or have any feedback, questions, or concerns about our privacy policy or practices, please contact us (see "How to Contact Us") with detailed information for investigation.

We have a process for investigating and handling privacy violations. Upon receiving a complaint, our privacy officer will investigate with relevant departments. The investigation will determine the nature and cause of the violation. If a violation is found, the privacy officer will work with senior management to correct processes and prevent further violations. We will contact you with investigation results. We strive to resolve all investigations within a reasonable timeframe.

We will handle your requests or complaints confidentially. Our representatives may contact you after receiving your complaint to discuss your concerns and outline resolution options. We are committed to ensuring your complaint receives timely and appropriate resolution.

We take reasonable measures to ensure overseas entities receiving your personal information do not breach privacy obligations and require overseas recipients to protect information in a manner generally equivalent to New Zealand regulations. These overseas recipients may disclose information we share with them according to foreign laws. In such cases, we will not be responsible for such disclosure.

This agreement takes effect from January 2025.
